Enforcing A Family Law Court Order
In Texas, when the other party is not fulfilling the obligations they were ordered to, a contempt order may be filed. The order can compel the other party to adhere to the rules by threatening steep fines or even jail time. A contempt order may be filed to enforce the following items:
- Failure to pay child support or spousal support payments
- Failure to comply with child custody or visitation orders
- Failure to comply with court-ordered property division
To prove that the accused party is in contempt, the original language on the court-ordered agreement must be clear and specific. For cases of failure to pay child support, the order must clearly state the amount, how often it must be paid, to whom and how it must be paid and until a specific date, among other guidelines. If the language fails to meet these requirements, the judge may choose to clarify the original order to give the accused party the opportunity to comply.
